Chrono, Inc. ("Chrono" or "We") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of personal information we may collect or that you may provide when you: use our websites (https://www.nexus.gg) (each a "Site", and collectively, the "Sites") or download, install, access, or use our Nexuses ("Nexuses", and together with the Site, the "Services"); and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect on the Services and in email, text, and other electronic communications sent through or in connection with the Services.
This policy DOES NOT apply to information that:
- We collect offline, or
- You provide to or is collected by any third party (see Third-Party Information Collection).
The Services contain links to third-party websites, products or services. The Services may also display content from third parties. Information collected by third parties is governed by those third parties' privacy policies. We encourage you to read these before providing information on or through them. Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Services. By downloading, registering with, or using the Service, you agree to this privacy policy. Children Under the Age of 16
Our Services are directed to a general audience, however, we are aware that children may be interested in the Game. We have partnered with K-ID’s Global Compliance Engine to assist us in ensuring that we receive appropriate verified parental consent before we collect Personal Data from minors in accordance with applicable laws. If we learn that we have collected or otherwise processed the Personal Data of a minor without the requisite parental consent, we will delete that information. If you have reason to believe that we have received or processed the Personal Data of a child through the Game without the requisite verified parental consent, please contact us at privacy@nexus.gg, and we will endeavor to delete that information from our databases. This is in compliance with the Children’s Online Privacy Protection Act and Article 6(1)(c) of the GDPR.
We collect several types of information from and about users of our Services, from two sources:
You, either directly when you provide it to us or automatically when you use our Services; and Third parties.
When using our Services, you may provide us with certain types of information, which may include, information that alone or in combination with other information in our possession could be used to identify you ("Personal Data").
This information includes:
- Information you provide us when you create an account. This information includes your display name, name, email address and password.
- Information and content that you provide us when you request a demo or fill out the Contact from on our Site. This can include your name, company name, email address and any other information you choose to provide.
- Information you provide when you subscribe to our email list. This information includes your email address.
- Your preferences, programs you have applied for, and transactions you’ve made through the Services.
- Information and content that you provide us when you interact with us on one of our social accounts (at present we have accounts on Twitch, Instagram, Facebook, YouTube, X, StreamLabs, StreamElements, Kick and Discord). This information includes the relevant social handle and any other information you choose to provide.
- Information that you provide us for the purpose of processing payments, if you are part of our Creator Program. This information includes payment information and may include information necessary to verify your identity. This information is collected on our behalf by our third-party payment processing vendor (see Third Party Service Providers below for more information).
- Records and copies of payments that we make to you related to the Creator Program.
Information that you provide us when applying for a job with us. This information may include your name, email address, resume, career history and any other information you choose to provide.
- Records and copies of your correspondence (including email addresses and phone numbers), if you contact us. This information may include your email address or phone number, depending on how you contact us, and any other information you choose to provide.
- Details of transactions you carry out through the Services and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Services. This information is collected on our behalf by our third-party payment processing vendor (see Third Party Service Providers below for more information).
When you download, access, and use the Services it may use technology to automatically collect:
- Usage Details. When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, logs, communication data and the pages and resources that you access and use on or through the Services.
- Device or Computer Information. We may collect information about your IP address.
- Email Open/Click Data: We use pixels in our email campaigns that allow us to collect your email and IP address, as well as the date and time you open an email or click on any links in the email.
If you do not want us to collect this information do not use the Services.
Do Not Track Disclosure
The Services do not support "Do Not Track" browser settings and do not currently participate in any "Do Not Track" framework that would enable us to respond to Do Not Track signals.

Like most websites, we use small data files that are saved on the user's computer, tablet, mobile phone or other mobile device (collectively referred to as "device") to record certain data each time a user logs in or interacts with our websites, services, apps, messaging systems and tools these are often referred to as “cookies”.

In connection with YouTube API Services, we may access, collect, and store certain user information, including data obtained through the YouTube API. This data collection is outlined as follows:

- Data Processing and Sharing: Collected data is processed by Chrono and shared only with publishers whose creator programs you apply for for the purposes of determining your qualifications to join the program and assessing your channel performance over time.

Our Legal Bases For Processing Your Information
When we collect or otherwise process any of your Personal Data, we do so in reliance on the following legal bases:
- Your consent. If you have provided us with your consent to process your information for a specific purpose, we will do so based on your consent. You may withdraw your consent at any time by following the instructions provided below in the “Your Rights and Choices” section below.
- Performance of a Contract with You. When the processing of your Personal Data is necessary in order for us to perform a contract with you or when you request that we process your information prior to entering into a contract with you, we will do so on this basis.

When we believe the processing of your Personal Data is reasonably necessary in order for us to achieve our legitimate interests in conducting and managing our business and our relationship with you, we will do so on this basis, including the legitimate interest we have in:

We use information that we collect about you or that you provide to us, including any Personal Data, to:

- Create anonymous, de-identified, or aggregated datasets (“Aggregated Information”). Such datasets would not be "Personal Information" subject to this Privacy Policy. The usage information we collect helps us to improve our Services and to deliver a better and more personalized experience by enabling us to:
- Estimate our audience size, demographics and usage patterns.
- Store information about your preferences, allowing us to customize our Services according to your individual interests.

- Identify and correct software defects.

Disclosure of Your Information
We may disclose aggregated information about our users and information that does not identify any individual or device without restriction.

- Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, email communication software and email newsletter services, advertising and marketing services, payment processors, customer relationship management and customer support services, and analytics services. Pursuant to our instructions, these parties will access, process, or store Personal Data in the course of performing their duties to us.
- Business Transfers: We may disclose your information to our subsidiaries and affiliates. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider (collectively a “Transaction”), your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.
- Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a court order, regulatory request or other legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Services, or the public, or (v) protect against legal liability.
- Enforcing our Rights: We may disclose your information as necessary to enforce our rights arising from any contracts entered into between you and us, including our Terms of Service and Terms of Sale.
- Necessary for Purpose: We may disclose your information as necessary to fulfill the purpose for which you provided it.
- With Your Consent: We may disclose your information with your consent.
- Other purposes: We may disclose your information for any other purpose disclosed by us and accepted by you when you provide the information.
In addition, we may disclose Personal Data that we collect or that you provide:
Creators: To the Creator, through whose Nexus you provide the Personal Data, so that they may provide you with the services or goods that you request through their Nexus. For example, if you support a Creator through their Nexus, we will share with them the information necessary for them to thank you. If you purchase from a Creator through their Nexus, we will provide them the information necessary to ship and track purchases, and provide you with information about their activities and other offerings. By using a Creator's Nexus, you consent to our sharing of the information that you provide with them. We provide education and resources to our Creators on the appropriate treatment of your personal data and require all Creators using our Services to agree to the terms of our Nexus Creator Data Processing Agreement to ensure the appropriate, lawful treatment of your Personal Data.
Where, How and How Long We Store Your Information
Nexus is based in the United States. As such, the information you provide is collected and stored in the U.S. We store your information securely using third-party vendors and hosting partners who implement industry-standard security measures. By using the Services, you authorize us to transfer, store and process your information in the United States and any other country where we operate.
We keep your information only for the length of time necessary to fulfill the purposes for which the information was collected. For example, if you have an account with us, we will retain the Personal Data associated with your account for the lifetime of your account. If you have provided your email address to us for the purpose of subscribing to our email newsletter, we will keep your email address for that purpose until you unsubscribe from our newsletter (Note: if you have provided your email to us for another purpose that remains applicable, we may maintain and use your email in connection with that other purpose). If applicable laws require us to store your information for a longer period, then we will keep your information for the period of time required by law. When it is no longer necessary or required for us to retain your data, we will delete it.
Cross-border Data Transfers: Where cross-border transfers of data are necessary, we will take reasonable steps to safeguard the privacy of your Personal Data. These steps may include implementing standard contractual clauses where recognized by law, obtaining your consent, or other lawful means of transferring Personal Data.
Data Security
We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure by partnering with third parties who use industry-standard security measures to protect your information. These measures include strict access control policies, employee training, data encryption in transit via HTTPS, and the use of secure third-party storage vendors.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted through our Services. Any transmission of Personal Data is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures we provide
Your Rights and Choices
In certain circumstances, providing Personal Data is optional. However, if you choose not to provide Personal Data that is needed to use some features of our Services, you may be unable to use those features.

- Deleting Your Personal Data: We provide all of our data subjects with the Right to be Forgotten (also known as the Right to the Deletion of your Personal Data ), whether or not you reside or are a citizen of the European Union or the United Kingdom. Please email us at the address above if you would like us to delete your Personal Data.
Please note, however, that the Right to be Forgotten is not an absolute right. The Right to be Forgotten only applies to the following types of Personal Data that are held by us at the time of the request:

- Personal Data that was processed on the basis of legitimate interests,
- Personal Data processed on a basis other than consent or legitimate interests that is no longer required for the purpose for which it was originally collected or processed,

- Third parties: We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

Your Data Rights: The laws of certain jurisdictions provide their residents with certain data protection rights. We strive to provide these rights to all of our users. These rights include:
- The right to access - You have the right to request Company provide you with copies of your personal data. We may charge you a small fee for this service.
- The right to rectification - You have the right to request that the Company correct any information you believe is inaccurate. You also have the right to request that the Company complete information you believe is incomplete.
- The right to be forgotten - You have the right to request that the Company erase certain types of personal data (see Deleting Your Personal Data above)
- The right to restrict processing - You have the right to request that the Company restrict the processing of your personal data, under certain conditions.
- The right to object to processing - You have the right to object to the Company's processing of your personal data, under certain conditions.

The Services and our business may change from time to time. As a result, we may change this Privacy Policy at any time. By continuing to use our Services or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
